By visiting and or using www.mousesale.co.uk or one of its associated sites (the site) and/or the services of Mouse Sale Ltd or one of its Independent Agents, you are confirming that you have read these terms and conditions and are agreeing to be bound by them.

mousesale.co.uk, mouselet.co.uk, mouselet and mousesale are trading names of Mouse Sale Ltd. The contents of www.mousesale.co.uk (the site) are subject to copyright and our logos are trademark protected.

Mouse Sale Ltd reserves the right to advertise properties for sale or to let on the site and the sites of third parties that we may change or add to at any time without notice. Mouse Sale Ltd cannot be held responsible for the availability, content, performance or otherwise of external sites, which we may from time to time be associated with or for any advice given by third parties. Where links to other sites are provided on the site, these are for information only. We cannot be held responsible for the content of third party sites. Property details will be uploaded to the site and those of our partners as soon as is practicable.

Mouse Sale Ltd will use reasonable endeavours to maintain the availability and performance of the site at all times but maintenance, updates and improvements may require us from time to time to take the site off line without notice. We cannot guarantee the continuous operation of the site free from interruptions or errors.

We will not be held liable if events outside of our control prevent us from fulfilling our obligations to you.

You must ensure that any properties you offer for sale or let via Mouse Sale Ltd comply with all UK legislation (such as, without limitation, the Property Misdescriptions Act 1991, The Sale of Goods Act, The Housing Act 2004 and The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007) and must not mislead or be inaccurate in any way, regardless of whether such legislation directly applies to you.

Mouse Sale Ltd does not take any responsibility for the accuracy of the information or photographs contained on the site and advise all prospective vendors and purchasers to take appropriate professional advice before entering into any contract. Photographs used must be provided with the owners consent. Mouse Sale Ltd will not be liable for any breach of copyright. The particulars contained by Mouse Sale Ltd are intended to give a fair and accurate description for the guidance of intending purchasers and do not constitute an offer or part of a contract.

You must confirm your property details are correct before marketing of the property can commence via Mouse Sale Ltd, This can be confirmed in writing, verbally or by logging on securely to the www.mousesale.co.uk website using your username and password. Mouse Sale Ltd reserves the right to amend property details on the site at our discretion.

Unless otherwise agreed in writing by Mouse Sale Ltd, only one property for sale or let will appear in each property description on the site per vendor.

Should you change your mind about using us to sell or let your property, a full refund of your fee will be made less an administration fee of £15.00 (which rises to £100 if a Mouse Sale Ltd agent has consequently visited your home to prepare particulars). You must inform us of your decision to cancel within 24 hours by e-mailing us via enquiries@mousesale.co.uk or you can call us on 0844 800 4437. Refunds are not available in any other circumstances. Your statutory rights as a consumer are not affected.

Once property details have been published on our website for a period in excess of seven days, our service is deemed to have been fully delivered.

Dependant upon the selling option selected, and unless otherwise agreed in writing by Mouse Sale Ltd, property details will be advertised on the site until sold or let for a maximum period of 12 months. Clients must inform Mouse Sale Ltd in writing (or via email) every three months if the property is still available for sale or to let otherwise we reserve the right to remove details from the site without notice.

If you have instructed another agent on a sole agency and/or sole selling/letting rights basis, the terms of those instructions must be considered to avoid the possibility liability to pay two sets of fees. Mouse Sale Ltd will not be held liable if a vendor or lessor is subsequently is bound to pay another agents fee.

For Sale or To Let boards provided by Mouse Sale Ltd are the responsibility of the vendor or lessor and must be erected in accordance with local planning regulations.

Mouse Sale Ltd reserve the right to withdraw from the site any property at any time without providing a refund if these terms are breached or if we suspect that the vendor or lessor may be engaging in any fraudulent or illegal activity.

The maximum liability for any loss arising due to our negligence will be limited to a sum equal to the value of the Mouse Sale Ltd selling or letting option fee received by us. The fees for our services are published on our website www.mousesale.co.uk.

We do not collect personal information from visitors to the site unless they give it to us. Only then will we use that information to contact them, respond to their enquiries and provide them with further information regarding our services. If you do not want us to send you further information, please notify us via the ‘contact us' section of the site or in writing. We do not pass information to third parties. We are happy to provide details of information held on request.

From 14th December 2007, it has been compulsory for homeowners in England & Wales to arrange for a Home Information Pack (HIP) to be prepared before putting their home up for sale and to make a copy of the pack available to any prospective purchaser on request. All vendors using the site confirm that where applicable, they have made necessary HIP arrangements including accompanying any written or electronic particulars of the property for sale with its energy and environmental ratings (the asset ratings) as required by law. This can be in the form of a copy of the HIP ratings graphs displayed as an image replacing one or more of the allowable photographs on the site.

Sellers who choose our ‘Platinum Plus’ selling option whereby payment is deferred, agree that this facility is provided by a third party of our choosing who may change from time to time without notice. You must therefore agree to the terms and conditions of the chosen HIP Provider and/or Finance Company who underwrite this facility otherwise we cannot provide it.

Sellers using our services shall indemnify Mouse Sale Ltd, its proprietors, directors, employees or agents against any claim made in respect of the property for sale or any misdescription that arises wholly or partially out of the act or default of the seller - including the non provision of a Home Information Pack where required by law.

Mouse Sale Ltd is a member of the Ombudsman Scheme for Estate agents and subscribes to the OEA Code of Practise – a copy of which is available on request.

Any dispute pertaining to the provision of our services is subject to the laws of England and Wales and any disputes arising will be submitted to the exclusive jurisdiction of the English Courts.
