As a landlord with a property to let, what are my responsibilities?

You will generally be responsible for:

  • repairs to the structure and exterior of the property to let, heating and hot water installations, basins, sinks, baths and other sanitary installations 

What about my tax position?

In general terms, you will be liable to pay tax on your gross income from property to let rents and will be able to deduct from them your day to day running expenses.

  • the safety of gas and electrical appliances 
  • the fire safety of furniture and furnishings provided under the tenancy 
  • ensuring that the property to let is fit for habitation 
  • repairing and keeping in working order the room and water heating equipment
  • the common areas in multi-occupancy dwellings

When you let your property to a tenant, the tenancy is automatically an assured shorthold tenancy (unless you agree otherwise in writing).

This means:

  • you can seek to regain possession of your property to let after 6 months, unless you have an agreed fixed term tenancy of longer 
  • you can charge a market rent for your property to let 
  • you can apply to the court to regain possession of your property to let if your tenant owes you at least two months' or eight weeks' rent, after having provided the appropriate notice 
  • tenants causing a nuisance to local people can be evicted from let property
